Win A Free Rascal Contest Rules – 2009 RULES
1. Promotion Description: No purchase is necessary. Must be a legal resident of the continental U.S., Alaska, Hawaii or Canada (residents of Quebec are not eligible) and be 18 years of age or older at the time of entry. Void where prohibited. Promotion begins on January 1, 2009 and ends on December 31, 2009 (the "promotion" period). There will be one (1) Grand Prize awarded in a random drawing within 2 weeks after the end of each month throughout the promotion period. Employees of Electric Mobility Corporation (dba The Rascal Company) and The Rascal Company of Canada, its affiliates, parent, subsidiaries, advertising and promotional agencies, and the immediate family members of those agencies are not eligible.
2. How to Enter: To enter, respond to a Win a Free Rascal Contest advertisement and provide your first and last name, complete address, and daytime telephone number. Alternatively, you may hand-print your first and last name, complete address, and daytime telephone number on a postage-paid contest entry postcard or on a piece of paper in an envelope and send it to: Win a Free Rascal Contest, One Mobility Plaza, P.O. Box 156, Sewell, NJ 08080. All entries must be received by 11:59 p.m. on the last day of each month. No responsibility is assumed by sponsor for lost, late, misdirected, illegible, mutilated, or postage due entries, or for any telephone, human error or technical malfunctions that may occur. All entries become the property of the sponsor and will not be returned. Entries are limited to one individual per year; additional entries will be discarded. Entry rules and limits apply equally to all forms of entry. Entrants will receive one entry per month per entry submitted, subject to the previous limitation of one entry per individual, per year, until the last drawing of the promotion. January entries will receive 12 monthly entries; February – 11; March – 10; April – 9; May – 8; Jun – 7; July – 6; August – 5; September – 4; October – 3; November – 2; and December – 1. No purchase or online subscription is necessary; there is no obligation at any time as result of an entry.
3. Winner Selection/Deadline Dates/Prizes: One (1) Grand Prize winner will be selected in a random drawing at the end of each calendar month throughout the promotion period and from among all entries received. There will be one (1) Grand Prize awarded for each drawing. A winner will receive their choice of one of the following: Rascal 115 Scooter, Rascal 760 Powerchair, or when available a Rascal We Go 250. Prize is not redeemable for cash. No substitution or assignment of prize is permitted, except for that the sponsor reserves the right to substitute a prize of equal or greater value in the event an offered prize is unavailable. The random drawings will be made within two (2) weeks after the last day of each calendar month of the promotion period under the supervision of Electric Mobility Corporation (dba The Rascal Company), whose decisions are final. Odds of winning each month depend on the number of eligible entries received and are approximately 1:250,000 based on previous response. Chosen winner candidate from Canada will be required to correctly answer a mathematical question before winning.
4. Rights and Responsibilities: No purchase is necessary to enter and making a purchase will not increase the chances of winning. By returning the entry form and entering the contest, you agree to be contacted by Electric Mobility Corporation (dba The Rascal Company (TRC)) and The Rascal Company of Canada about its products even if you are on the Do Not Call list, unless you call 1-800-563-0294 and notify us that you do not wish to be called. Entries are subject to the official rules, which can be obtained by visiting TRC’s website, www.rascalscooters.com, calling 1-800-662-4548, or writing P.O. Box 156, Sewell, NJ 08080. Entry into the contest gives you the right to enforce the official rules against TRC, and you agree to abide by the official rules. By entering, you grant certain rights to TRC and you agree to pay any applicable sales tax relating to the prize if you should win.
5. Prizes: There will be one (1) Grand Prize awarded for each month. A winner will receive their choice of one of the following: Rascal 115 Scooter (ARV $1,795), Rascal 760 Powerchair (ARV $1,995), or when available a Rascal We Go 250 (ARV $2,495). Prize is not redeemable for cash. No substitution or assignment of prize is permitted, except for that the sponsor reserves the right to substitute a prize of equal or greater value in the event an offered prize is unavailable.
6. Eligibility: This contest is open only to legal residents of the United States and Canada, 18 years of age or older at the time of entry. Void where prohibited by law.
7. General Conditions: Contest entrants agree to be bound by the terms of the official rules and by the decisions of the judges that are final and binding on all matters pertaining to this contest and accept that those rules have financial implications. Entrants also agree that Electric Mobility Corporation (dba The Rascal Company) and its affiliates may call them about its products in the future even if they are on the Do Not Call list. The laws of the United States and Canada govern this contest. All federal, state, and local laws and regulations apply. All taxes on prizes are the sole responsibility of the prizewinners. The prizes will be awarded and the winners will be notified via telephone or mail within three (3) weeks of the drawing date. Grand Prizewinners may be required to execute and return the affidavit of eligibility and liability/publicity release within seven (7) days following the date of attempted notification. Non-compliance within this time period may result in disqualification and the selection of an alternate winner. Return of any undeliverable prize/prize notification may result in disqualification and selection of an alternate winner. Entrants further grant to sponsor the right to use and publish their name and city of residence in any media in connection with the contest. Acceptance of a prize constitutes permission for sponsor to use winner's names, comments, and likeness for advertising and promotional purposes without additional compensation unless prohibited by law. By entering, participants consent to contact by mail, phone, and any other electronic means from Electric Mobility (dba The Rascal Company) and the Rascal Company of Canada regarding our products. Entrants release and hold harmless Electric Mobility Corporation (dba The Rascal Company), its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with this contest or any prize won. If for any reason the program is not capable of running as planned due to technical failures, or any other causes beyond the control of sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission or for communication line failure. Sponsor is not responsible for any problems or technical malfunction of any telephone network or line resulting in failure of any entry to be received by sponsor.
